BY ACCESSING OR USING THIS PLATFORM, YOU AGREE TO BE BOUND BY THESE TERMS OF USE, PRIVACY POLICY AND SUCH OTHER AGREEMENTS, AS MAY BE ADOPTED BY US FROM TIME TO TIME. PLEASE READ THESE TERMS CAREFULLY BEFORE ENTERING INTO A TRANSACTION ON THIS PLATFORM.

THIS DOCUMENT IS AN ELECTRONIC RECORD UNDER THE INFORMATION TECHNOLOGY ACT, 2000 AND RULES THEREUNDER. THIS ELECTRONIC RECORD IS GENERATED BY A COMPUTER SYSTEM AND DOES NOT REQUIRE ANY PHYSICAL OR DIGITAL SIGNATURES.

THIS DOCUMENT IS PUBLISHED IN ACCORDANCE WITH THE PROVISIONS OF RULE 3 (1) OF THE INFORMATION TECHNOLOGY (INTERMEDIARIES GUIDELINES AND DIGITAL MEDIA ETHICS CODE) RULES, 2021 THAT REQUIRE PUBLISHING THE RULES AND REGULATIONS, PRIVACY POLICY AND TERMS OF USE FOR ACCESS TO OR USAGE OF THIS PLATFORM.

1. General

1.1 The Platform is owned and operated by Krupa Corporation Private Limited (“Krupa Homes”), having its registered Registered Office: Door No. 8-21, Krupa House, Beside Gulcose Factory, Perecherla, Guntur, Andhra Pradesh – 522009.

1.2 Your use of the Platform is governed by the following Terms of Use as applicable and the Agreements (defined below) provided separately on the Platform and which are or may hereafter be incorporated herein by way of reference (“Terms of Use”). If You transact on the Platform, You shall also be subject to the Agreements that are applicable to the Platform for such Transaction. By mere use of the Platform, You shall be contracting with Krupa Homes, and these Terms of Use including the Agreements constitute Your binding obligations, with Krupa Homes.

1.3 Definitions

  • (a) “Affiliate” shall mean, with respect to each party, any person or entity directly or indirectly through one or more intermediary Controlling, Controlled by, or under direct or indirect common Control with a party.
  • (b) “Platform” shall mean this internet based e-commerce services platform owned and/or operated, directly or indirectly, by Krupa Homes, including any website, application, web app, landing page, iOS/Android application or any other digital interface.
  • (c) “GST” means goods and services tax under applicable Indian laws.
  • (d) “Krupa Companies” shall mean and include Krupa Corporation Private Limited, its subsidiaries, associate companies, joint ventures and Affiliates.
  • (e) “KYC Documents” means such ‘know your customer’ documents as may be required to be submitted to Krupa Homes from time to time.
  • (f) “Profile” means the individually identifiable profile of User created at the time of registering on the Platform.
  • (g) “Transaction” means the process of booking and availing Services.
  • (h) “User Content” means content including data or information provided by You on the Platform.
  • (i) “We” or “Us” or “Our” or “Krupa Homes” means Krupa Corporation Private Limited or any of its subsidiaries or Affiliates.
  • (j) “You” or “Your” or “User/s” means a legal person who is given access to use the Platform.
  • (k) “Contractors” or “Service Providers” means independent third-party construction contractors listed on the Platform.

1.4 By accessing or using this Platform, You agree to be bound by these Terms of Use, the Privacy Policy and related agreements (“Agreements”). In the event of conflict: Privacy Policy shall prevail over other Agreements (except Terms of Use). These Terms of Use shall prevail over notices/disclaimers on the Platform.

1.5 All monies on the Platform are displayed in Indian Rupees. Prices are exclusive of applicable GST and other taxes unless specified otherwise.

2. Services

2.1 Krupa Homes owns and operates the Platform, using proprietary technology to connect Users with Contractors and facilitate building construction services (“Services”).

2.2 Platform services are subject to repudiation or cancellation by Krupa Homes at any time without obligation to provide reasons, including cancellation under statutory or judicial directions.

3. Access to the Platform

  • You must be 18 years or older and legally capable of entering into contracts under the Indian Contract Act, 1872.
  • Krupa Homes reserves the right to suspend or terminate access without assigning reasons.
  • A limited, non-exclusive, non-transferable, revocable license is granted to access and use the Platform for personal purposes only.

4. Profile & Information

  • Users must register and create a Profile.
  • Username and password are confidential and non-transferable. You are responsible for all activity under your account.
  • Krupa Homes may suspend or terminate accounts with false/inaccurate information.
  • Mobile number/email are primary identifiers.
  • Krupa Homes may verify KYC, contact you for promotional purposes, and modify or delete profiles as required.

5. Electronic Communication

You consent to receive communications electronically from Krupa Homes. Platform availability is subject to internet limitations and may be suspended for maintenance.

6. Platform Role

  • The Platform only facilitates communication and payment.
  • The construction contract is strictly between User and Contractor.
  • Krupa Homes does not guarantee performance of Contractors.

7. Acceptable Use

You agree not to:

  • Upload unlawful, defamatory, obscene, misleading or infringing content.
  • Violate Indian laws including IT Act, IPC, GST laws.
  • Use automated data extraction tools.
  • Engage in fraudulent or deceptive practices.
  • Resell services or use for commercial profit unless permitted.
  • Krupa Homes may cancel orders classified as Business Use.

8. Payment

  • Payments must be in INR.
  • Payment methods: Net Banking, NEFT, RTGS, Credit/Debit Cards, Cheques, E-wallets.
  • Platform may deduct TCS/TDS as per GST and Income Tax laws.
  • Krupa Homes is not a banking institution.
  • Financing partners may be introduced but repayment obligations remain with the User.

9. Intellectual Property

All intellectual property on the Platform belongs to Krupa Homes or licensors. No copying, modification, resale or commercial use is permitted without prior written consent.

10. User Content

You grant Krupa Homes a license to use and modify User Content for business, analytics and platform development purposes.

11. Third Party Content

Third party content is provided “As Is”. Krupa Homes does not guarantee accuracy or reliability.

12. Disclaimer & Limitation of Liability

Platform provided “as is” without warranties. Krupa Homes shall not be liable for:

  • Service failures by Contractors.
  • Indirect, incidental, consequential damages.
  • Loss due to unauthorized account use.
  • Maximum aggregate liability shall not exceed the greater of INR 100 or fees paid for the relevant transaction.

13. Indemnity

You agree to indemnify Krupa Homes against any claims arising from your breach of these Terms or violation of law.

14. Amendments

Krupa Homes may amend these Terms at any time. Continued use implies acceptance.

15. Governing Law & Dispute Resolution

  • Governed by laws of India.
  • Exclusive jurisdiction: Courts at Mumbai, India.
  • Disputes to be resolved via arbitration under the Arbitration and Conciliation Act, 1996. Seat & venue: Mumbai. Language: English.
